Details required by Art. 49 of the Italian Consumer Code and Art. 7 of Legislative Decree 70/2003.
2. Scope
These terms govern the distance sale of natuRa.Ely garments to natural persons acting outside their trade or profession (consumers) and, so far as compatible, to businesses. The Italian Consumer Code (Legislative Decree 206/2005) and the European rules on distance contracts apply.
It. Legislative Decree 206/2005 · Dir. 2011/83/EU · It. Decree 26/2023 (Dir. (EU) 2019/2161) · It. Decree 70/2003
3. The garments: single pieces, living colour
Every garment is hand-sewn, numbered and signed. Linings and silks are dyed with plants, roots and leaves: the colour is born in the vat and never repeats itself exactly. Slight differences in tone, variations in the botanical print and the irregularities natural fibres carry are not defects: they are how these fabrics exist, and we describe them for what they are.
The photographs show the garment actually for sale, but colour rendering depends on the screen you are using. On request we will send further images or a short film before you buy.
Fibre composition is stated on each page in accordance with Reg. (EU) 1007/2011. As these are single pieces, each garment exists in one example only: once sold, it cannot be reproduced identically.
4. Prices
Prices are in euro and include VAT and any other applicable tax. Shipping within Italy is free. At present, delivery is available in Italy only.
We may change prices at any time: the price that applies to you is the one displayed when you send your order.
5. How an order is made
Sending an order constitutes your offer to purchase. The contract is concluded when we confirm acceptance by email, with a summary of the pieces, the price, the timing and the delivery address. Before you send it we show you an editable summary and ask you to accept these terms; the confirmation button states the obligation to pay.
We may decline an order — refunding at once anything already paid — if the garment has been sold meanwhile, if the details are incomplete or plainly wrong, or if payment fails.
6. Payment
For online purchases, the available payment methods are shown at checkout. Card transactions take place on the payment provider’s encrypted channels with strong customer authentication under Dir. (EU) 2015/2366: your card details never pass through our systems and are never stored by us.
The invoice or sales document is sent to you by email.
7. Shipping and delivery
Orders are shipped from Italy with tracked delivery. Shipping within Italy is complimentary. At present, delivery is available in Italy only. Destinations other than Italy cannot be selected when ordering.
The Pelèr coats offered on the site are finished garments. For any tailoring alterations or made-to-measure work, the applicable production time is communicated to the customer in writing before the order is confirmed, and is to be counted separately from transit time, which runs from dispatch. Delivery takes place in any case within thirty days of the contract being concluded, unless a shorter period is stated in the order confirmation (Art. 61 Consumer Code).
Risk of loss or damage passes to you when you, or a third party you designate other than the carrier, take physical possession of the garment (Art. 63 Consumer Code). If the parcel arrives visibly damaged, accept it with reservation and write to us within a few days: we will take care of the rest.
If we fail to deliver in time, you may ask us in writing to deliver within an additional period and, if that too passes, terminate the contract and obtain a full refund.
8. Right of withdrawal: fourteen days
If you are a consumer you have the right to withdraw from the purchase without giving any reason within fourteen days of the day you receive the garment (Arts. 52–59 Consumer Code).
How to exercise it
An explicit statement sent before the deadline to naturaely@libero.it or by post to our address is enough. You may use the model form in Annex I, Part B of the Consumer Code, but you need not: an email saying you wish to return the garment, quoting your order, will do. We acknowledge receipt without delay.
The return
The garment must be sent back within fourteen days of that notice, intact, worn no more than was necessary to try it, with its labels. The direct cost of return is at your expense; we recommend a trackable service. You are liable for any diminished value resulting from handling other than what was necessary to establish the nature, characteristics and functioning of the garment.
Where the return is sent from a country outside the European Union, any customs charges and import or export duties connected with it may be payable by you, where the law of that country provides for them. Duties and taxes you paid directly to the customs authorities never reach us and we cannot refund them, unless the applicable law requires it.
The above applies to withdrawal. If the garment is wrong, faulty, damaged or otherwise not in conformity with the contract, the cost of return and every other expense needed to put it right are ours, under the statutory warranty of conformity: we ask you for nothing and we arrange the collection ourselves.
The refund
We refund everything you paid, including standard delivery charges, within fourteen days of being informed of the withdrawal, and in any case not before we have received the garment or proof of dispatch. We use the same means of payment you chose, at no extra cost.
When withdrawal does not apply
Withdrawal is excluded for garments made to your measurements or clearly personalised at your request — altered sizes, bespoke lengths, embroidered initials, dyeing commissioned specially — under Art. 59(1)(c) of the Consumer Code. We say so plainly before work begins, and we do not proceed without your informed consent.
9. Legal guarantee of conformity
Every garment carries the statutory two-year guarantee of conformity from delivery (Arts. 128–135 Consumer Code, as amended by Decree 170/2021). Where a garment is not in conformity you are entitled, at your choice, to repair or replacement and, on the conditions laid down by law, to a price reduction or termination with refund.
There is no obligation to report the defect within two months. To rely on it, write to us describing the fault with a few photographs: if the garment can be mended, in most cases we mend it ourselves, by hand, free of charge. Ordinary signs of wear, damage from washing contrary to our care instructions, and the natural variations of plant dyes described in clause 3 are excluded.
10. Made to measure and alterations
If you ask for an alteration — shorter sleeves, a different collar, a length of your own — we agree measurements, timing and price in writing before cutting. Notes left in the basket count as a request but become binding only once we confirm. At that point we remind you that withdrawal does not apply to personalised garments.
11. Product safety
The garments comply with Reg. (EU) 2023/988 on general product safety and with textile labelling rules (Reg. (EU) 1007/2011). The responsible person for the purposes of the Regulation is the seller named in clause 1, established in Italy. The substances used in dyeing are of plant and mineral origin and comply with Reg. (EC) 1907/2006 (REACH).
12. Complaints and disputes
Write to us: complaints reach the two of us directly and we answer within five working days. Almost everything is solved by talking.
If that is not enough, before going to court you may use an alternative dispute resolution procedure under Italian Decree 130/2015, implementing Dir. 2013/11/EU — for instance before the conciliation bodies of the Chambers of Commerce (Chamber of Commerce of Trento) listed by the Italian Ministry of Enterprise. Taking part is voluntary and you give up no rights by doing so.
As to jurisdiction, consumers retain the mandatory forum of their place of residence or domicile (Art. 66-bis Consumer Code).
13. Intellectual property
Texts, photographs, drawings, the natuRa.Ely name and mark are ours and protected by copyright and trade mark law. Photographs of the garments may not be reproduced, downloaded or reused — not in part, and not to train automated systems — without our written consent. All rights under Art. 4 of Dir. (EU) 2019/790 are reserved.
14. Governing law and changes
The contract is governed by Italian law. If you reside in another EU Member State, the mandatory more favourable provisions of your own country still apply. The invalidity of one clause does not affect the others.
These terms may change: the version that applies to your order is the one published when you send it, and a copy comes with your confirmation. In case of divergence, the Italian version prevails.
We have written these lines the way we would speak in the atelier: if something is unclear, ask. A garment that leaves with a doubt does not leave well.
